India May Treat Meta as a Service Provider, Increasing Its Responsibility for Content

Indian government officials say Meta should be treated as a service provider rather than only an intermediary because its algorithms actively recommend, amplify, and distribute content on Facebook, Instagram, and Threads. Such a change could put its intermediary safe-harbour protections under greater scrutiny. However, the final determination of Meta’s legal liability would rest with the judiciary.
