Court Strikes Down $100K H-1B Visa Fee

A U.S. appeals court has rejected the Trump administration's proposed $100,000 fee for new H-1B work visas. Upholding a lower court's ruling, the judges determined the exorbitant charge functions as a tax, which only Congress has the authority to impose. Introduced in 2025, the fee would have made hiring highly skilled foreign talent—especially in the tech sector—prohibitively expensive.
